Terms of Service

These Terms of Service ("Terms") govern your access to and use of Createen (the "Service"), operated by Dawid Zbiński ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
1. Acceptance of the Terms
By accessing or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and "you" refers to that organization. If you do not agree, you must not use the Service.
2. Description of the Service
Createen is a software-as-a-service workspace for content creators and agencies. It provides tools to manage clients, projects and tasks, to upload and review media, to handle invoices and payments, to schedule content, and related features. We may add, change, or remove features over time. The Service is provided on an ongoing basis and we may release updates, improvements, or modifications at any time.
3. Accounts and Eligibility
To use most features you must register for an account. You agree to provide accurate and complete information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You must notify us promptly at hello@createen.pl of any unauthorized use.
You must be at least 16 years old (or the age of digital consent in your jurisdiction) and capable of forming a binding contract to use the Service. The Service is intended for business and professional use and is not directed at children.
4. Acceptable Use
You agree not to, and not to permit anyone else to:
- use the Service in violation of any applicable law or regulation;
- upload, store, or transmit content that is unlawful, infringing, defamatory, or that violates the rights of others;
- attempt to gain unauthorized access to the Service, other accounts, or our systems and networks;
- interfere with or disrupt the integrity or performance of the Service, including via malware or excessive automated requests;
- reverse engineer, decompile, or attempt to extract the source code of the Service except as permitted by law;
- resell, sublicense, or otherwise commercially exploit the Service without our prior written consent.
We may suspend or restrict access if we reasonably believe your use breaches these Terms or risks harm to the Service or others.
5. User Content and Intellectual Property
You retain all ownership rights in the content you upload, create, or store using the Service ("User Content"). We do not claim ownership of your User Content. You grant us a limited, worldwide, non-exclusive license to host, store, process, transmit, and display your User Content solely to the extent necessary to operate and provide the Service to you (including via the subprocessors described in our Privacy Policy).
You are solely responsible for your User Content and represent that you have all rights necessary to upload and use it within the Service. The Service itself, including its software, design, branding, and all related intellectual property, remains the exclusive property of Dawid Zbiński and its licensors. No rights are granted to you other than the limited right to use the Service under these Terms.
6. Fees and Subscriptions
Some features of the Service may require a paid subscription. Pricing, billing cycles, and plan features are described at the point of purchase and may change from time to time. We will give you reasonable notice of material price changes for your current plan. Unless otherwise stated and except as required by applicable consumer law, fees are non-refundable. You are responsible for any applicable taxes.
7. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends. We will make your User Content available for export for a reasonable period where feasible, after which it may be deleted in accordance with our retention practices described in the Privacy Policy. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any automated feature (such as AI-assisted invoice field extraction) will be accurate. You are responsible for reviewing and verifying any automatically generated output before relying on it. Nothing in these Terms limits rights you may have as a consumer that cannot be excluded under applicable law.
9. Limitation of Liability
To the maximum extent permitted by law, Dawid Zbiński shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service. Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) EUR 100 (one hundred euro). These limitations do not exclude or limit liability that cannot be excluded or limited under applicable law (including for death or personal injury caused by negligence, or for fraud).
10. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-law rules. The courts of the courts competent for the entrepreneur's registered seat (Nowy Targ, Poland) shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory consumer-protection law grants you the right to bring proceedings in your place of residence.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms here with a new "Last updated" date or by notifying you in-app or by email). Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
